Franny's Kitchen, LLC (“Franny’s Kitchen,” “we,” “us”) prepares and delivers home-style meals in San Francisco and operates this website. This Privacy Policy describes how we collect, use, and disclose your personal information when you visit our website, create an account, place an order, buy or redeem a gift certificate, sign up for our newsletter, or otherwise communicate with us (together, the “Services”). If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to your personal information.

Personal Information We Collect

“Personal information” means information that identifies or can reasonably be linked to you or another person. Depending on how you use the Services, we may collect:

Contact details, including your name, email address, and phone number.
Delivery details, including the addresses you save, the name of the person receiving a delivery, map coordinates for the address, and any delivery instructions you give us, such as where to leave your meals.
Account information, including your password, which we store only in hashed form, and your newsletter preference. If you sign in with a passkey, we store its public key, a name for it, and when it was last used. The private key and any fingerprint or face data stay on your device and are never sent to us.
Order information, including what you order, when, your comments on the order, and your order history.
Payment information, including the amounts you owe and have paid, your account balance, and how you paid, such as by check, cash, or card. Card payments are made on a checkout page hosted by Square, so your full card number is entered with Square and is not stored by us.
Gift certificate information, including the name and email address of the buyer, the name and email address of the recipient if provided, and any gift message. If you enter someone else’s details, please make sure they would be happy for you to share them.
Communications, including what you tell us when you email, call, or text us.
Device and usage information, including your IP address, browser and device type, the times you sign in, the pages you view, and technical information about errors and page performance.

Where We Get Personal Information

Directly from you, when you create an account, place an order, or contact us.
From another customer, when someone buys a gift certificate for you or names you as the recipient of a delivery.
Automatically, from your device when you use our website, including through cookies and similar technologies.
From our service providers, such as payment confirmations from Square and address matches from our address verification service.

How We Use Personal Information

To provide the Services, including creating and managing your account, verifying your address, preparing and delivering your orders, tracking your balance, taking payment, and issuing and redeeming gift certificates.
To communicate with you, including order confirmations, balance reminders, account and security notices, and customer support.
To send our newsletter, including the weekly menu, if you have subscribed. The sign-up form has a newsletter checkbox that you can untick.
To protect the Services, including signing you in securely and detecting spam, fraud, and abuse.
To run and improve our business, including fixing errors, understanding how the website is used, and keeping accounting and tax records.
For legal reasons, including complying with the law, responding to valid legal requests, and enforcing our terms.

How We Disclose Personal Information

We do not sell your personal information, and we do not share it for other companies’ advertising or direct marketing. We disclose it only in these circumstances:

With service providers who work on our behalf:

Square, to process card payments and keep a customer record. It receives your name and contact details and handles your card details under its own privacy policy.
SendGrid, to send account, order, and gift certificate emails.
Mailchimp, to send our newsletter. It receives your email address and name if you subscribe.
Geocodio, to verify delivery addresses. It receives the address you enter.
Google, for Google Analytics, which helps us understand website traffic, and reCAPTCHA, which helps keep bots off our sign-in, sign-up, and gift certificate forms. These collect device and usage information under Google’s privacy policy.
Bugsnag, to monitor website errors and performance.
Heroku, which hosts our website and database.

In other circumstances:

When you ask us to, such as emailing a gift code to the recipient you name.
In connection with a sale or transfer of our business.
To comply with the law, respond to subpoenas and similar requests, enforce our terms, or protect the Services, our rights, or the safety of others.

Cookies and Do Not Track

We use cookies to keep you signed in, to remember you if you choose “remember me” (for up to a year), to protect our forms, and to remember whether a passkey has been set up in your browser. Google Analytics and reCAPTCHA also use cookies, and third parties such as Google may collect information about your activity on our website over time. You can block or delete cookies in your browser, but you may not be able to sign in without them.

Our website does not currently respond to Do Not Track signals or the Global Privacy Control.

Third-Party Websites and Links

Our website links to sites we do not control, such as Square’s checkout page and our social media pages. Those sites have their own privacy practices, and we are not responsible for them.

Children’s Data

The Services are intended for adults. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has given us personal information, please contact us and we will delete it.

Security and Retention

We use safeguards such as encrypted connections and hashed passwords, but no security measures are perfect, and we cannot guarantee absolute security. Please do not email us sensitive information such as card numbers.

We keep personal information for as long as we need it to maintain your account and provide the Services, and afterward as needed to meet accounting, tax, and legal obligations, resolve disputes, and enforce our agreements. If your account is closed, we keep records of your orders and payments for those purposes.

Your Rights and Choices

Access and correction. You can review and update your contact details, addresses, and orders in your account, or ask us for a copy of the personal information we hold about you or to correct it.
Deletion. You can ask us to close your account and delete personal information we are not required or permitted to keep.
Marketing emails. You can stop our newsletter at any time using the unsubscribe link in any issue. We will still send non-promotional emails, such as those about your orders or account.

To make a request, contact us using the details below. We may need to verify your identity first, and we will not treat you differently for making a request. Some privacy laws give residents of certain places additional rights, and we will honor those that apply to us. California residents may also ask us about disclosures of personal information to third parties for their direct marketing; as stated above, we do not make such disclosures.
